It seems to me that this will be settled where it should be - in court. Unfortunately, the media - for the most part - lack the ability to understand and therefore explain the complexities of the case to the general public. In stead, they rely on sound bites.

In any event, given the recent turmoil in the market and the "computer glitch" that cost small investors large portions of their retirement savings, I see the soon to retire "Baby Boomers" pulling out of the market wholesale. They tend to be mistrustful of "Wall Street" and "technology". I also haven't seen the Obama administration doing anything to shore up their confidence, despite the fact that many of them are reaching an age where they can move their money without penalties.
